City of New York v. Central Organization of Municipalities, 523 U.S. 614 (1998), was a United States Supreme Court case that held that a New York state law that set a term limit of two four-year terms on members of New York City Council, did not violate the federal constitution's separation of powers or Equal Protection Clause.
Background
In 1993, the state of New York passed a law that limited the number of four-year terms that council members could serve to two. The law also required that council members be re-elected every four years, with terms staggered so that they are not elected on the same day or election cycle. The purpose of the law was to limit the influence that city council members could have on city policymaking.
In 1996, New York City brought a lawsuit against the Central Organization of Municipalities, arguing that the law violated the separation of powers and Equal Protection Clause of the 14th Amendment.
Decision
The Supreme Court, in a 6–3 opinion written by Justice Sandra Day O'Connor, held that the law did not violate the separation of powers or Equal Protection clause, primarily because a state law cannot prevent the council from functioning as a body.
